§ 22-29. Enforcement procedures.

  • Unless flight by the person or other circumstance makes it impractical, a town law enforcement officer, upon finding a minor in violation of this article, shall:

    (1)

    Require the suspected minor to identify himself by name, age, and address;

    (2)

    Make every reasonable effort to verify the name, age, and address of the suspected minor, through written documentation, contact with a parent, or otherwise;

    (3)

    If the person is a minor, ascertain the minor's reason for being in the public or semipublic place during restricted hours;

    (4)

    If the minor is in violation of this article, take the minor into custody and immediately transport the minor to police headquarters or a police substation. After recording pertinent information about the minor, police department personnel, or designated volunteers, shall attempt to contact the parent or guardian of the minor and, if successful, request that the parent or guardian respond to the police station to take custody of the minor. Upon the arrival of the parent or guardian, the minor shall be released to their custody. If town police personnel are not able to contact the minor's parent or guardian within two hours after the minor is taken into custody, or if the parent or guardian refuses to take custody of the minor, then a town police officer may transport the minor to the minor's residence or proceed as authorized by F.S. ch. 39.

    If the minor has committed a second or subsequent violation of this article, document the prior warning and charge the minor with a violation of this article.
